This Beta Program Addendum ("Addendum") supplements and forms part of the Alatus Academy Terms of Service ("Terms") and Privacy Policy. Capitalized terms used and not defined here have the meanings given in the Terms. By participating in the Alatus Academy beta program (the "Beta"), you agree to this Addendum. To the extent of any conflict between this Addendum and the Terms during the Beta, this Addendum controls.
The Beta is a voluntary, pre-release version of Alatus Academy made available to a limited number of parents for testing and feedback. The Beta is provided as a free trial of indeterminate length through our payment processor (Stripe); no recurring subscription charge is made during the Beta trial period (see Section 6 below). The Beta is provided at our discretion and may be modified, suspended, or discontinued at any time, in whole or in part, with or without notice. Features available in the Beta may change, be removed, or behave differently in the generally available version of the Service. The Beta is not the final product.
THE BETA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, AND WITHOUT ANY SERVICE-LEVEL OR UPTIME COMMITMENT. YOU ACKNOWLEDGE THAT THE BETA MAY CONTAIN BUGS, ERRORS, INACCURATE OUTPUTS, AND OTHER DEFECTS, AND THAT GENERATED CURRICULUM AND ASSESSMENTS MAY BE INCOMPLETE OR INCORRECT. YOU ASSUME ALL RISK ARISING OUT OF YOUR USE OF THE BETA AND OF ANY GENERATED CONTENT.
If you choose to provide feedback, suggestions, bug reports, feature requests, or other input regarding the Beta ("Feedback"), you grant Alatus LLC a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, create derivative works of, distribute, and otherwise exploit the Feedback for any purpose, without any obligation or compensation to you. We are not required to use any Feedback you provide.
Information about the Beta that is not publicly available — including non-public features, performance characteristics, prompt designs, and roadmap information — is our confidential information. You agree not to disclose such information to any third party during the Beta or for one (1) year after the Beta ends, except as required by law. You may discuss your own experience using the Beta and the content it generates for your family.
Data you enter during the Beta is governed by the Privacy Policy. In addition, you acknowledge that:
The Beta is provided as a free trial of indeterminate length through Stripe; no recurring subscription charge is made during the Beta trial period. The subscription, auto-renewal, billing, and refund provisions in Section 4 of the Terms of Service apply in full during the Beta. The recurring monthly charge processed by our payment processor (Stripe) at signup, and the discrete-transaction receipt Stripe sends for each successful payment, are also the operative method of Verifiable Parental Consent under our COPPA Parental Consent Notice §6 and 16 CFR §312.5(b)(2). You may cancel at any time from the in-app subscription portal; cancellation takes effect at the end of the current billing period, and revoking your COPPA consent (deleting your account) cancels the subscription immediately as described in the COPPA Notice.
You may stop participating in the Beta at any time by deleting your account from the in-app dashboard or by emailing support@alatusacademy.com. We may end your participation in the Beta, or end the Beta entirely, at any time and for any reason.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALATUS LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE BETA WILL NOT EXCEED USD $100. THIS LIMITATION APPLIES IN LIEU OF, AND NOT IN ADDITION TO, THE LIMITATION IN SECTION 12 OF THE TERMS DURING THE BETA PERIOD.
Sections 2 (No Warranties), 3 (Feedback License), 4 (Confidentiality), and 8 (Liability) survive the end of the Beta and any termination of your participation.
